inlingua Augsburg Website Privacy Policy (GDPR)

The protection and security of your (hereinafter referred to as ‘users’) personal data (hereinafter referred to as ‘personal data’) within the meaning of Art. 4 No. 1 of the General Data Protection Regulation (hereinafter referred to as ‘GDPR’) is important to us. Accordingly, we comply with the legal requirements to provide adequate protection for the personal data of every user. Below, we would like to inform you about the nature, scope and purpose of the processing of personal data:

inlingua Augsburg (hereinafter referred to as ‘inlingua Augsburg’) processes personal data exclusively within the framework of the GDPR and within the provisions specified in Art. 95 GDPR in conjunction with Sections 11-15a of the German Telemedia Act (TMG).

This data protection declaration (hereinafter referred to as ‘DPE’) provides the information required under Art. 13 GDPR for the general use of the website www.inlingua-augsburg.de.

Users have the option of taking an online placement test in English, German, Italian, Spanish and French. In addition to linguistic characteristics, the test also asks for a self-assessment and the following personal data within the meaning of Art. 4 (1) GDPR.

4. Purposes of collection and storage of personal data (Art. 13 (1) (c) GDPR)

a. Accessing the website / free downloads

Log files are processed to ensure the functionality of the website. The data is also used to optimise the website and to ensure the security of the information technology systems. The data is not evaluated for marketing purposes.

b. Contact

The data provided by the user within the scope of the contact options will be processed exclusively for the purpose of processing the user's request.

c. Placement test

The data transmitted by the user within the scope of the placement test will be used to determine a language course that is suitable for the user's language level and for the relevant exchange/communication between inlingua Augsburg and the user.

d. Registration for language courses

The data is processed exclusively for the purpose of conducting and administering the language course or language examination.

5. Recipients/third parties/third country transfers (Art. 13 (1) (e) and (f) GDPR)

In addition to inlingua Augsburg and its branches in Augsburg and Potsdam, recipients of the data may include third parties who process data on behalf of inlingua Augsburg or who have access to the data within the scope of their services to inlingua Augsburg (e.g. IT service providers) as well as other language service providers on whose behalf inlingua Augsburg acts or who act on behalf of inlingua Augsburg (e.g. TOEIC, telc). Corresponding order processing agreements exist in accordance with Art. 28 GDPR.

User data will not be transferred to third parties (Art. 4 No. 10 DSGV) unless the user expressly consents to this. Personal data will only be transferred to government institutions and authorities within the framework of legal regulations.

All data is stored on servers or computers within the European Union; it is not transferred to third countries, nor is this intended.

6. Cookies and analysis tools

a. Cookies

inlingua Augsburg uses so-called ‘cookies’. Cookies are small text files that store website settings, e.g. in the user's web browser, when using the website. Cookies serve to make the website easier to use. The cookies used by inlingua Augsburg are session ID cookies. These are only stored for the current session in the user's web browser and are automatically deleted when the browser is closed. Every user is free to prevent the installation of such cookies by adjusting their browser settings accordingly. In this case, however, it may not be possible to use all functions of the website to their full extent.

b. Google Analytics

inlingua Augsburg uses the web analytics service Google Analytics. The provider is Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. Google Analytics also uses cookies (see above). The information generated by the cookie about the use of this website is usually transferred to a Google server in the USA and stored there. However, if IP anonymisation is activated on this website, the user's IP address will be truncated by Google within member states of the European Union or in other states party to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transferred to a Google server in the USA and truncated there. On behalf of inlingua Augsburg, Google will use this information to evaluate the use of the website by users, to compile reports on website activity and to provide other services related to website activity and internet usage to the website operator. The IP address transmitted by the user's browser as part of Google Analytics is not merged with other Google data.

Users can prevent the storage of cookies by adjusting their browser software settings accordingly; however, inlingua Augsburg points out that in this case, not all functions of this website may be fully usable. In addition, users can prevent the collection of data generated by the cookie and related to their use of the website (including their IP address) by Google, as well as the processing of this data by Google, by downloading and installing the browser plugin available at the following link: tools.google.com/dlpage/gaoptout.

c. Google AdWords

inlingua Augsburg uses the online advertising programme ‘Google AdWords’ and, as part of Google AdWords, conversion tracking. Google Conversion Tracking is an analysis service provided by Google Inc. (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; ‘Google’). When the user clicks on an ad placed by Google, a conversion tracking cookie is stored on their computer. These cookies expire after 30 days, do not contain any personal data and therefore do not serve to personally identify the user.

When users visit certain pages on the website www.inlingua-Augsburg.de and the cookie has not yet expired, Google and inlingua Augsburg can recognise that the user has clicked on the ad and been redirected to this page. Each Google AdWords customer receives a different cookie. This means that it is not possible to track cookies across the websites of AdWords customers.

The information collected using the conversion cookie is used to generate conversion statistics for AdWords customers who have opted for conversion tracking. Customers are informed of the total number of users who clicked on their ad and were redirected to a page tagged with a conversion tracking tag. However, they do not receive any information that can be used to personally identify users.

Customers who do not wish to participate in tracking can object to this use by preventing the installation of cookies through a corresponding setting in their browser software (deactivation option). They will then not be included in the conversion tracking statistics. 7. Social media

a. Google Maps

Plug-ins for the Google Maps service, a service provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, are also used. When the website is accessed, the server is informed which website the user has visited. In addition, Google stores the IP address of the browser on the user's device. b. Facebook

The inlingua Augsburg website also contains links to the social network Facebook, which is operated by Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA (hereinafter referred to as ‘Facebook’).

When the user clicks on the Facebook link, they are redirected to the Facebook profile of inlingua Augsburg. If the user is logged in to Facebook as a member at the same time, Facebook assigns certain information to the personal Facebook user account.

c. YouTube

Plug-ins from the Google-operated website YouTube are also used. The operator of the site is YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA (hereinafter referred to as ‘YouTube’). When the user visits the website, a connection to the YouTube servers is established. The YouTube server is informed which of our pages the user has visited.

If the user is logged into their YouTube account, this enables YouTube to assign the user's surfing behaviour directly to their personal profile. The user can prevent this by logging out of their YouTube account before visiting the website.

8. Legal basis for data processing (Art. 13 (1) (c) GDPR)

a. Accessing the website / free downloads

The legal basis for processing data using cookies, analysis tools and log files is Art. 6 (1) (f) GDPR. Our legitimate interest lies in providing a functionally flawless and user-friendly website.

b. Contacting us by email

The legal basis for the processing of data transmitted in the course of sending an email is Art. 6 (1) lit. f) GDPR if the sender is not yet a customer or does not already have a business relationship with us in another way. If a contractual relationship already exists or is to be initiated immediately at the sender's initiative, the legal basis is Art. 6 para. 1 lit. b) GDPR.

c. Placement test

The legal basis for processing personal data in the context of the placement test is Art. 6(1)(b) Var. 2 GDPR.

d. Registration for a language course or language exam

The legal basis for processing personal data in connection with registration for language courses and language exams is Art. 6 (1) lit. b) Var. 2 GDPR.

9. Duration of storage (Art. 13 (2) (a) GDPR)

The data will be stored until it is no longer necessary for the purpose for which it was collected or until consent is revoked, subject to the restrictions of Art. 17 (3) GDPR.

The data will therefore be deleted as follows:

•    Log files: Every 60 days

•    Downloads: upon completion of the download

•    Contact by email: The data will be deleted three months after the enquiry has been answered, unless further communication on the same subject has taken place before the expiry of this period or the data is still required due to a contractual relationship (for the purpose of contract processing/execution) or must be retained in accordance with statutory retention obligations in accordance with the prescribed period.

• Placement test: After six months, provided that no contract has been concluded during this period.

• Course registration: one year after completion of the course, unless there is a reason for retention in accordance with Art. 17 (3) GDPR, in particular if a longer retention period is required due to statutory retention obligations.

• Language exam registration: one year after completion of the exam, unless there is a reason for retention in accordance with Art. 17 (3) GDPR, in particular if a longer retention period is required due to statutory retention obligations.

10. User rights (Art. 13 (2) (b) – (e), Art. 7 (3) GDPR)

If the legal requirements are met, the user has the right to obtain information about personal data stored about them by inlingua Augsburg at any time, Art. 15 GDPR, as well as the right to rectification, Art. 16 GDPR, restriction of processing, Art. 18 GDPR, and erasure of their data, Art. 17 GDPR.

If the user has asserted their right to rectification, erasure or restriction of processing vis-à-vis inlingua Augsburg, inlingua Augsburg will notify all recipients to whom the personal data in question has been disclosed of this rectification or erasure of the data or restriction of processing, unless this proves impossible or involves disproportionate effort.

The user also has the right to revoke consent once given (Art. 7, Art. 6(1)(a) GDPR), Art. 7(3) GDPR. Proper revocation of consent does not affect the lawfulness of data collection that has taken place up to that point.

In addition, the user has the right to object at any time, on grounds relating to their particular situation, to the processing of personal data concerning them which is carried out on the basis of Art. 6 para. 1 lit. e) or f) GDPR, Art. 21 GDPR.

In addition, if the legal requirements are met, the user has the right to receive the personal data that they have provided to inlingua Augsburg in a structured, commonly used and machine-readable format (right to data portability, Art. 20 GDPR).

To exercise these rights, the user should contact the offices specified in sections 1 or 2.

Furthermore, if the legal requirements are met, the user has the right to lodge a complaint with a supervisory authority, Art. 77 GDPR.
